Abstract


Both water and air are flowing constantly. The environment issue is closely interrelated with daily life of every single person.Aim to ensure decisions are scientific and democratic,“Public participation of Environmental Impact Assessment system”assembled social forces significantly to paticipate the decisions in those human events which will affect environmental quality.From the basic theory on Public participation of Environmental Impact Assessment, this article introduces advanced foreign legislative theory and practical experience, and reviews Public participation of Environmental Impact Assessment system of China. The perspective on improving Public participation of Environmental Impact Assessment system through institutional guarantee of legislation and public environmental awareness is also discussed in the paper.Chapter I of the paper from an environmental impact assessment system in hand, for environmental impact assessment system to be a more comprehensive presentation. Describes history of environment influence evaluation system, EIA and environmental effect evaluation system differences and relations and environment influence evaluation system of content. Combined with the related legal theory defines the connotation of public participation in environmental impact assessment, demonstration of rationality and legitimacy of public participation in environmental impact assessment, revealing the value of public participation in environmental impact assessment of goals--to achieve environmental justice and achieving sustainable development goals.Chapter II United States is the world’s first implementation of environmental impact assessment system of the country. Through the United States introduction and analysis of public participation in environmental impact assessment system, came to United States public participation in environmental impact assessment system on China’s many implications. At the same time, China’s environmental impact assessment of the case, analysis of present situation of public participation in environmental impact assessment, pointed out that the current deficiencies of public participation in environmental impact assessment system in China and problems to be solved urgently.Chapter III discussion on measures to improve public participation in environmental impact assessment system. Through legislative improvement on the one hand, in legislation establishing the environmental right of citizens to determine the legal status of public participation in environmental impact assessment system, provides an adequate legal basis for public participation; on the other hand, a series of supporting system of public participation in environmental impact assessment. Perfecting the system of freedom of information, ensure that the public environment right; perfect the mechanism of public participation, ensure the public’s environmental right of participation in relief guarantee mechanism for establishing, maintaining the public’s environmental claims. Finally, increase the intensity of environmental propaganda and education, raise public awareness, public participation to environmental protection in the building.
