Abstract

People may inquire and spread message data instantaneously in space of the improvement ofeconomic society and the popularization ofnetwork technology.There are so many differentmessages around ourlives,they nall"OWthe gap between people,and also reducethe distance between human and society.Howevertheyletthefree spacein ourheart diminished , so people pay more and more attention on the problem ofprotecting privacy.At the sarfle time.because of raising awareness ofthe right to know and improvement of information technology,the system of public mcord has been promoted quickly,being the most important branch ofmessage field Great amount ofmessages data and various records have been entered,recorded,so people can inqu~e and get them easily.But read the message differ from publicizing it,there includes personal message data in the enoFnlous public record, if somebody publicizing the private message,the party’s privacy should be aggrieved,and mBke the party in the scene ofperplexed,embarrassed,and failedAt present,the privacy is firstly ruled as one ofthe civil benefits in the Torts Law,which is fmally made the privacy as the independent personal right for protection in the legal system that shows the progress ofthe protection ofpdvacy in China.However the expanding of the privacies would be the ignorable fact and the there are many problems in the privacy protection in the public record.And how to open the public resources under the protection of individuals’privacies would be the explorations and practices by the other countries So this paper would like to analyze the violations over the privacy in the public records and give the relative policiesThewholetextis dividedintofourparts andtheparttwoandpartfourarethefocusesin this paper.Part one is to introduce the generation and the development ofthe privacy and its expanding over the basic theories about the privacy and the protections around the world Part two is manly to analyze the concept ofthe public records,the reasonable expectation of the privac the violations ofthe public records.Part three is to demonstrate the current situations and disadvantages in the legislation and the mechanisms Part four is to give the suggestions that should make the perfections of the legislation,especially for the professional privacy laws while the relative mechanisms t0 strengthen the idea ofthe self-control at the salne time to standard the utilization of public records for the balance ofthe privacy protections over the analysis of the relative rules and systems abroad and combining with the current protections andtheproblemsinChineseprivacyprotection
