Abstract


Private equity fund, as an important form of investment funds in China, becomes more and more important to promote the development of the social economy. The international private equity funds have attached importance to the market of China; however the development of the Chinese private equity fund is still rather slow. In order to promote the development of the economy of our country, we should pay more attention to the development of private equity fund, which needs more attention to the legislation of private equity.This paper, which is consisted of three parts, studies the private equity fund in perspective of law on the basis of analyzing its characteristics and application mechanisms.The first part introduces the overview of private equity fund from the concept, the characteristics and application mechanisms, the function and the current development in our country.The second part has a study on the legislation of private equity fund in China. This part begins to introduce the legislation of other countries and regions, after that, analyze the legislation of current development in our country.The third part gives the advision of the legislation in China. This part tells that private equity fund should be regulated by law. Our country should legislate an private equity fund law which regulates private equity fund systematically and suits to the current national condition of our country. The efficiency and safety must be the value of the law. The principles of protection of investors and supervision according to law are necessary to the law.
