Abstract


Witness of Criminal Procedure of the rights and obligations of the serious imbalance in the existing laws lack of protection for the rights of witnesses , is the importance of our witnesses appear low , the trial reforms that failed to achieve the desired result , the adversarial mode can not be effective operation one of the reasons . Compared to many foreign countries , China's Criminal Procedure Law \lack of maneuverability and can not be effectively implemented . Therefore, on the basis of the presented witnesses rights protection system of the typical common law and civil law countries , learn from foreign advanced practice some insight on building a system of protection of the rights of our witnesses , including the establishment of a comprehensive witness program the sexual rights protection system and witness protection system , setting the right to economic compensation of our witnesses and refused to permit the right to make a little contribution to the development of China 's Criminal Procedure Law .
