Abstract


Released on bail is the investigation, prosecution and judicial organs of criminal prosecution and has not been a person in custody in the course of criminal proceedings , to prevent avoid detection , prosecution and trial , and ordered to provide a guarantor or pay the security deposit , and issue a guarantee , to ensure that with the pass with a coercive measures . 1996 Amending the Criminal Law , the provisions of the bail system is more complete , the bail system is indeed a big step forward to the goal of the rule of law , but there are still many problems in the legislation and practice , a narrow range of objects , where applicable , apply low to ensure a single way , bail period is too long , and so on . Bail system has many similarities with the release on bail , after more than nine centuries of evolution , has a fairly complete system , its basic philosophy and even the specific initiatives of our bail system perfect draw considerable significance . Some scholars have proposed a fundamental reform the bail system , that the introduction of the western countries of the bail system to completely replace our bail system . I believe that the reform of the bail system is more than just a mandatory reform measures affect the situation as a whole , is involved in many aspects of the litigation philosophy, substantive law as well as criminal investigations mechanism reform . In addition , China 's specific national conditions determine all transplant bail system is unrealistic . Therefore , with regard to the reform of the bail system , only consider drawing on the bail system of the Anglo-American countries , and gradually improve the in our existing bail system based on its .
