Abstract


This paper is divided into four chapters. Chapter I start from the connotation of legal aid and its composition mode, and through the analysis of the object of legal aid, to further clarify the positioning of the lawyers in the legal aid system and the role of lawyers in the later interpretation of the legal aid system to provide theoretical and practical foundation. Chapter II start to clear the status of lawyers in the legal aid from lawyers in the legal aid in positioning. This article discuss the role of lawyers in the legal aid focus in the third chapter, the chapter focuses on the role played two of the lawyers in the legal aid system, namely the role of social justice and the role of maintaining order. In this paper, the fourth chapter discusses how to strengthen the role of lawyers in legal aid, and proposed the establishment of the legal aid system development path. Today's Chinese society is increasingly complex legal, social justice, the country should not be demanding parties familiar with the law. The same time, some of the parties can not afford the high cost of lawyers. If the the lawyer assistance system is not perfect, then the demands of social justice at the system level, will be difficult to achieve, and thus force the parties to seek the way to solve outside the system. This article aims to reveal the significance of the achievement of social justice through argumentation assistance of counsel, the status and role of lawyers in the legal aid system, as well as the assistance of counsel system in the case of different legal value conflict against the rights of citizens, justice demands and social order The significance of the balance between, to prove the positive role of the lawyers for the realization of social justice and maintain order. Subjective constitute legal aid from around the world to see its basic component is by private lawyers and public officials, a full-time lawyer. Outside legal service providers in the attorney general auxiliary work only complete legal aid, legal aid agencies to complete some of the day-to-day administrative work or paralegal to handle aid cases. So, the lawyers took on the work of the vast majority of legal aid, and more familiar with the procedures and legal affairs for litigation lawyers engaged in legal work all year round, compared to the notary and general grassroots legal staff and lawyers can be more excellent legal aid work, to play a greater role. This article will focus on the positioning and the role of lawyers in legal aid. The positive role of the systems for legal aid, China is still in the development stage, there are still many institutional deficiencies, this article introduce lawyers to provide legal aid, reinforcing adverse litigation status of vulnerable groups, or to provide special assistance for criminal suspects not limited to the scope of the legal aid system.
