Abstract


Criminal defense to refute their defenders face criminal charges in the criminal proceedings against the complaint in accordance with the law , in fact beneficial to one's own material and opinions of litigation and legal activities . It originated in the West and a legal system prevalent in modern countries , it marks the formation of a social thinking of the meaning and spirit of the criminal justice reached a new level . The criminal justice in certain rights to its conditions and purpose of the restrictions or denial of the criminal charges , in the criminal proceedings , it is necessary to pay attention to prevent improper segmentation of the interests of the accused persons , to protect the legitimate rights and interests of the accused persons . Therefore, the establishment of a good criminal defense system has a very important significance . This paper attempts to trace the origin and development process of the criminal defense system , to clarify the need to improve our criminal defense system , analyzing the existing problems in the current system of criminal defense , its causes , and on this basis to propose recommendations to improve our criminal defense system .
