Abstract


The usufructuary right is raised and developed for settling the contradictions between the own and the needs of materials during the practice of human society. It is important to improve the development of social economy. Benefit through the improvement of the use of property rights system, non-owners to meet the needs of the property of others, the use of the property, will help to achieve social stability and therefore fair and reasonable to construct Usufruct system is of great practical significance, initially set up by China Usufruct system. For these provisions, the system of, with emphasis on Usufruct functions to comply with the statutory principle of property rights perspective to build Usufruct system, the legal system of China’s property development and improve the focus. The paper on the definition used Usufruct start through the Usufruct system with the concept, characteristics, nature and history and the main types of research, combined with the actual situation in China’s current main use comparative analysis and system analysis method, in the retrospective analysis of our system with the development of Usufruct on the basis of historical context, according to the Property Rights Law theory to explore the development, and improve our existing system with Usufruct right.
