Abstract


Personal information has become important social resources in the information society. A large number of personal information has been collected improperly, which has brought a series of adverse effects to our work and life, some even threatened life safety. The collection, utilization and protection of personal information have become a global problem. Nowadays, with the globalization of information legislation, China has brought personal faith protection into the legislative agenda. The basic theory of personal information and the legislation on personal information protection in China are discussed in this paper.This paper consists of introduction, text and conclusion, the text is divided into three chapters.1. The theoretical basis of the personal information protection. This chapter first briefly introduces the basic concept of personal information and its legal characteristics. Then, expounds the theoretical basis of personal information protection from the aspects of legal basis, value basis and practical significance. The constitutional foundation and rights bases of personal information protection have been explained. It reflects the multiple value pursuit, the selection and reference of the European Union and the United States, and promotes the development of a harmonious legal society.2. The basic content of personal information protection. This chapter describes the subject of personal information and its contents of rights. The subject of personal information is a natural person. The users of personal information and their obligation are introduced; the restriction of personal information protection has been discussed from the aspects of public interests, the approval of the subject of the information and the legal rights of others. Then, infringement of personal information and its legal responsibility have been introduced.3. China’s legislation of personal information protection and suggestions. This chapter presents the legal status and the existing problems of personal information protection legislation in China, and discusses how to perfect China’s legal protection system of personal information. International (the European Union, the United States and Japan) personal information protection legislation and experience may be used as reference. Finally, the problem faced by the legal protection of personal information in China has been discussed and suggestions have been put forward.
