Abstract

Legal supervision power is our constitution procuratorial organs of a very important power。And civil litigation law supervision, it is the procuratorial organs perform an important part of the legal supervision. Protect lawful rights and interests of the parties in safeguarding judicial justice, play a positive role. But, with the civil litigation law of procuratorial supervision work constantly gradually, the launch of the deep ,current civil law supervision mechanism defects are also increasingly critical leakage and emerges. This paper tries to use and civil litigation law of the relevant data and procuratorial supervision in the author’s practice of see and feel, Intuitive reflect at present our country civil procedure law supervision work especially local prosecutors’ office in the difficulties and problems needed to resolve. Including civil case in court check direct problem in the work exists mainly in the following points: First, the civil case in court check direct case of decreasing year by year, total diabetes mellitus cases decreased. Second, accepts the cases accepted, unreal and protested cases accepted exist between structural contradictions. Third, the parties to the civil prosecutorial supervision work understanding degree is not high. Fourth, the civil prosecutorial supervision work development exist imbalance. Investigate its reason, the generation of these problems is mainly due to civil litigation law supervision mechanism in the lack of legislation、Civil lawsuit supervision in the judicial process inadequate and to the civil lawsuit supervision of procuratorial work enough attention ,the three big reason under the common function of the product.Suggested local prosecutors’ office on civil lawsuit supervision gradually develop diabetes mellitus cases . To further perfect the relevant legislation and change the procuratorial organs to the civil case in court check direct work attitude. And really attain to promote the civil case in court check direct job role.
