Abstract


2008 world financial crisis reignite the community 's attention on regulatory issues . Venture Capital as an economic activity in high-risk industries , the need of laws, policies to regulate them , to strengthen supervision to ensure that the risk capital industry healthy and orderly development . On the public interest , rent-seeking theory, interest group theory of regulation theory regulatory supervision of Venture Capital is the basic theory of the legal system . Especially in the context of the world financial crisis , we must fully coordinate regulatory innovation and investment relationship between risk and take appropriate regulatory principles . The world's major venture capital regulatory regime centralized regulatory system , autonomous regulatory institutions and intermediate three types of regulatory regime , our country should be taken to China Securities Regulatory Commission as a risk investments mainly regulatory authorities , and to industry self-regulation and internal controls to supplement the centralized regulatory approach, pending the operation of venture capital industry is more mature and norms , to raise both stressed the legislative management, but also focus on self-management of intermediate regulatory regime transition. Both for venture capital investments for risk practitioners or organizations must implement strict market access system, while the strict Shichangjinru auxiliary system to strictly limit the scope and venture capital funds to invest , to take investment risk risk prevention and mitigation measure. On how to strengthen the China Venture Capital special subject a government regulation on venture capital should be taken to change the government works , as soon as possible to establish private capital as the main risk capital formation mechanism, establish a comprehensive, whole process of regulatory systems and establish a government venture accountability system and other measures.
