Abstract


Environmental impact assessment system is an important environmental governance system, In the process of implementation of environmental impact assessment, Effective disclosure of environmental information is an important channel for exchange and is also two-way communication for the construction unit, the EIA approval agencies and government departments. The public participation and efficiency in many aspects are decided by the quality of information disclosure. Therefore, the EIA process which is good or bad in the quality of information disclosure on the part of the EIA has a very important role in the work.With the recent years, a series of problems caused by the environmental assessment of major environmental point of view of public events, EIA information disclosure issues often become the fuse or direct driving force caused public events. EIA information disclosure explore these issues in its first EIA Game between the interests of all parties, It is also the interests of all differences, leading to the practice of law in the application of different, The EIA of construction project information public information disclosure law in the main, content, loopholes in the way stakeholders to circumvent the law as a shield, These problems together lead to the construction project environmental impact assessment of the quality of information disclosure and public participation in the low environmental impact assessment of construction projects and inefficient degree, then place the public on environmental protection departments of the government and the crisis of confidence between the two sides of the conflict is not surprising. This conflict has not only damaged the public’s environmental rights and interests related to, but also caused the destruction of environmental resources and quality, so improve the development of the EIA information disclosure is imperative.The solution to the problem, firstly to define the EIA information disclosure, followed by the transformation of government and public awareness of their environmental ideas and to amend "the EIA Law," and establish accountability mechanisms for government-related; Clarify its content and expand its exceptions to the scope of disclosure, the other should be available to the public the EIA report; Finally, laws and regulations, standard and open way and clear the relevant procedures, while establishing mechanisms for public supervision and control channels. Of course, problems may be far more than these, the solution will not be limited to this. With the development of environmental science, environmental legislation, environmental rights and interests of the public body has become more sophisticated, and environmental public interest litigation in China to establish, the EIA will be more transparent system of information, environmental assessment information to enhance two-way interaction, in the face of environmental public events, government and the public also will be more mature and rational attitude to face each other.
