Abstract


Shortage of resource is now becoming the bottleneck of the economic and social construction. Ocean is the resources of spaces with a great strategic-significance. Liaoning Province, making a full use of the large areas of ocean that are available, is developing the marine economy, which has been supported by the central government. The plan of Liaoning’s coastal economic revitalization is expected to be the new national strategy. On the basis of such a situation, this paper analysis the problems existed in the building of coastal economic belt. This paper proposes a suggestion on establishing Liaoning special protected marine areas and making legislation for it. The article includes three parts:Chapter 1 introduced the current situation of Liaoning Coastal economic belt. According to the problems founded in the research of Dalian Changxing Island Harbor Industrial Zone and Dalian Industrial Park Zhuanghe Huayuankou field, the author summarized the problems occurred in Liaoning coastal economic development zone currently, the exploitation, and its effect on the marine environment.Chapter 2 focused on the status quo of the theoretical basis and legal provisions for special protected marine areas. The theoretical foundation on special protected marine areas included the definition of it, basic tasks of it and construction principles; In addition, it analyzed the development of the status quo of China’s special protected marine areas, and introduced the provisions of International Conventions on special protected marine areas, the current legislative situation of special protected marine areas in China.Chapter 3 facing with the shortcomings incurred in Liaoning coastal economic belt construction and marine environmental protection, it recommended through establishing special protected marine areas in Liaoning and making local legislation for it in order to protect marine environment during the coastal economic belt construction. In the practice of building coastal economic belt, some problems were found, such as marine environmental pollution caused by marine engineering, sea-use management chaos, destructing the legal stability by economic belt-building activities. In order to deal with all the problem, the paper held that Liaoning marine protection laws and regulations had yet to be perfected, it was proposed to develop Liaoning local laws and regulations of special protected marine areas. On the basis of the theory of special protected marine areas, and with the reference of The Interim Measures for the Administration of Special Protected Marine Areas and Zhejiang Province Interim Measures for the Administration of Special Protected Marine Areas in particular the definition of protected areas, legislative purpose, the management of the content, the management system, law enforcement were all explained in detail in the paper.
