Abstract


At present, there has been much international attention focused on the juvenile crime. According to statistics that total amount of Juvenile offender in China has began to decline in past five years, but Juvenile crime situation is still not optimistic, tendency of low age still serious. Unfortunately, Juvenile offender Community correction is not taken seriously, and the community correction organization are completely lacking. Community correction becomes a means of punishing criminals in China, following the program’s inclusion in the latest AmendmentⅧto the Criminal Law. With the perfection of implementing regulations, Juvenile offender Community correction becomes the event of inevitable choice.With the transition of society, under the background of human-oriented and building the harmonious society,we close attention to Community corrections of the judicial system in recent years. How to build the community correction system for Juvenile offender is that we are all concerned about. Reference to Community correction for juvenile crime in foreign country, relying on the existing legal regime, the author analyses and demonstrates the Legal Foundation of the Juvenile offender community correction, intends to constructs an effective、determine、complete system of community correction for juvenile offender.The main body of this thesis consists of five parts: The first chapter will be the exordium .Chapter 2 is A Summary of Juvenile offender Community correction, definition the concept of Community correction in broad sense and narrow sense, analyzed Juvenile offender Community correction theory value and practice significantly. Chapter 3 is based on analyzing present situation and existing problems of Juvenile offender Community correction, emphasis on Community correction legislation and practice. Chapter 4 briefly introduced the practice of community correction for juvenile offender of extraterritorial Application, emphasis on United States and Japan. Chapter 5 is proposes some suggestions on how to constructed and consummates the system of Juvenile offender Community correction under our country legal rule, and put up own some viewpoints. the conclusions are drawn and the development and application of establishing a working system of Community correction for juvenile offender.
