Abstract


With the idea of autonomy democracy, widely recognized, the administrative hearing system is becoming the core system of modern administrative procedure, in urban and rural planning, introduction of the hearing system is the urgent requirement of democratic administration. With the benefit diversification and citizen consciousness in the social transition period is rising, the hearing activities are becoming an important way and form of fight for the interests in the city planning and management process. But our country promulgated" urban and rural planning law" on the specific system did not make the detailed rules, this article combined with the hearing system and city planning specific functional areas, details from the start, and reality closely, direct government practice, in view of our country urban and rural planning system in the procedure of hearing cases less, in the decision-making process related departments and experts on the form such as the meeting more than public hearing problems, puts forward the comprehensive construction of the hearing system in China’s urban and rural planning system, reference and comparison of domestic and foreign legislative experience about hearing study of China’s urban and rural planning, system of public hearings on scope and mode, the main hearing, the hearing procedures and the effectiveness and other aspects, and to foresee the problems and difficulties, targeted to learn from foreign hearing system, the relevant procedures and practices, according to the situation of our country from the microcosmic operation level on how to improve China’s hearing system in urban and rural planning system, discusses how to further improve China’s urban and rural planning area of the hearing system.
