Abstract

Residency , refers to non- resident owners of housing rights of others . Residency system originated in Roman law , was at that time under special historical conditions for the protection of vulnerable groups in the field of marriage and family living benefits products , mainly exist in civil law countries under the European Civil Code . Of China's civil law system, the system has not been specified . However, judicial interpretation , and some local regulations have provisions similar concepts . This was the era of China's implementation of public housing mainly for the protection of marriage and the family within the housing needs of vulnerable groups , to achieve social assistance function played a protective role. Meanwhile tenure system is a reflection of a people-centered socialist concept of law , in order to further optimize the allocation of resources residing facilitate better solve the housing problem of the masses has played a positive role. Private property rights in our country can be more securely protected by law today, our legal system on the residency system should be in a pluralistic, open attitude be revalued in order to fully explore its modern spirit, and strive to grasp its function transmutation to achieve the desired functionality.
