Abstract


In China, using legal means to protect the equal rights of minorities in the field of education , has always been an important tool for the party and the state to promote the development of minority education. At present, along with the implementation of the western development strategy, as well as the deepening of the reform of China’s national education, especially after the promulgation of the 1995 "Education Law", full implementation of managing education and school in accordance with the law has improved. We have established a sound system of education laws and regulations for the main task of developing minority education. Education legislation of minority autonomous regions is an important part of the whole ethnic minority education legislation. Until 2006, mere are nine local education legislations have enacted by the minority autonomous National People’s Congress. But compared to China’s more than 150 minority autonomous regions, these legislations are far from enough. Therefore, generalizing the successful experience of national education legislation and analyzing the problems and their causes, which has important theoretical and practical values to continue promoting the development of education legislation in minority autonomous regions.This paper makes a special study on QianXinan BuYi and Miao Minorities Autonomous. Firstly, the paper from the legislative background, the legislative bodies, the legislative process and the legislative supervision etc four aspects, to make a preliminary analysis of the survey. Secondly, the paper from the educational management system, educational activities, investment in education, teachers, special policy and legal responsibility six aspects, to make a deep analysis of the survey. In the end, the paper based on the analysis of the past two surveys to identify the problems that exist in the current education legislation of QianXinan, and finally offering some practical proposals. In this paper, the research value and the research objective are very clear, the paper is not only to have found out the characteristics in QianXinan education legislation, more importantly, the investigation also has searched the problems throughout the QianXinan education legislation, and even have identified the causes of these problems, then make some relevant recommendations. All of these are very important to help QianXinan establish a rich and perfect education legislation system. In addition, the study’s findings and analysis is a reference for other Southwestern Autonomous regions. Moreover, in minority autonomous regions, this study can achieve a certain degree of improving the legislative advocacy and raising the awareness of the role of education law.
