The owner committee is our country in recent years the emergence of new things, is a modern city development of the property management in the process of the emergence of a new type of social organization. Owners committee in property management services in the field of an increasingly important role, for regulating the property management work and promote the construction of harmonious communities is significant. But in practice, the owner committee’s legal status is very embarrassing. This mainly displays in:" property law"," property management regulations" and other relevant laws and regulations of owner committee generated, operation conditions and made principle provision, but its legal status is not clear, so that the owner committee’s legal status, rights and obligations and so on in the" vacuum" region, in practice the court practice is not consistent. Based on this, the article is based on the legal research level, combined with the related judicial practice, the system of the owners committee to study the related problems. This paper firstly owner committee system theory discussed, is designed for the following research provide theoretical basis, based on this, this article is based on the actual situation of our country and the legislation practice, to our country the system of the owners committee undertook an analysis, pointed out that China’s legislation for the owner committee’s legal status to be determined, set up running mechanism and detailed, and other organizational relation should be clear, supervision mechanism remains to be perfected stage by stage owners committee mechanism is not sound and the management function dislocation and other issues, and put forward to perfect the proposal of the system.
