Abstract


The real estate industry is in a pivotal position in the national economy of each country, with the rapid appreciation of real estate, the concept of the ownership of the real estate. The basis of the legal system of modern real estate and real estate registration system, and the legal basis for the real estate registration agency for real estate registration, the establishment and improvement of the legislative development of the system of world real estate trend, much the world jurisprudence and legislators concerned about . For a long time, China's real estate registration system is the lack of uniformity, normative and operability. Currently on the real estate registration system settings, although the introduction of the Property Law has been clear to the Chinese government's determination to protect real estate property, it reflects the dynamic protection static protection and transaction security of real estate property rights, establish our real estate registration system of the basic principles for the formulation of future real estate registration law provides the overall framework and structure, but in the era, society, environment, environmental background factors, our current set on the real estate registration system is not perfect, even if walk in registration forefront of Shanghai, there are some urgent study and solve the problem, need to further improve the unified registration system of real estate, the censorship of the registration of real estate and real estate registration error compensation system. Address the problem, we start from the overview of real estate registration jurisprudence, the legal basis and the social function of the real estate registration system, and foreign real estate registration system founded on the principal legal theory, pattern and characteristics of the system compared analysis; review of the course of development of the real estate registration system to analyze the economic background and the legal relations of the real estate registration system in Shanghai, encountered in the work on the basis of the successful practices from domestic and foreign real estate registration system, combined with typical cases, the use of case analysis, the combination of theory and practice, a combination of qualitative and quantitative, of the unity of the Shanghai real estate registration system, registration censorship, registration error compensation system needs to be improved, and how sound and perfect the Shanghai real estate registration system corresponding countermeasures and suggestions: First, improve the uniform registration system of property rights; Second, improve the censorship of the real estate registration; Third, establish a reasonable real estate registration error compensation mechanism.
