Abstract


In treating "corrupt" horrible diseases,SunZhongshan did a "prescription" as supervisory authority. This "prescription" is taken by sun yat-sen from the good of "TCM" and "western medicine" , by the idea of a landmark of "corrupt",also an example of "make the past serve the present, foreign things serve”,and a large development to create and system construction. "The Chinese revolution, for more than its hold socialist, has following my country inherent thinker, a touch of the rules that the theory of Europe, our performance by himself alone." This sentence tells quite comprehensively the sun yat-sen, the source of five-power constitution,as the five rights legislation, administration and jurisdiction from western powers separation of the three powers doctrine and practice, and supervision, examination two rights are from ancient Chinese tradition idea and practice. Chinese traditional has both cream and dregs, and so as the west. If the two are mixed together, there will be only worse;conversely, if will assemble the essence of both in China is undoubtedly a great contribution to human. Sun yat-sen had a good taste and he chose the latter.China’s current regime isn’t entirely a decentralized system of government, therefore, there is no constitutional sense five-power division of powers or supervisory authority. China’s current supervisory authority is just a kind of executive power, It also did play a role in maintaining social order and civil rights and LianJieXing aspects in guarantee officials. But it is undeniable that in the present social transformation, its drawbacks has been exposed, it has failed to effectively curb the expansion of executive power, corruption in common spread.Although the five-power constitution supervision system and ideology of the right to has big or small shortcomings in practice, it has nothing to do to research it,and also has nothing to do to interfere with the significance of the surveillance system. For the current supervisory system,I only have one word from Sun Yat-sen: The revolution has not yet succeeded, comrade still need to take efforts.
