Abstract

Financial markets around the world have been affected by the’Credit Crunch’saga in America. Global unemployment is becoming a major crisis, thus affecting the stability of state political situation and social environment. Implementing unemployment insurance as a solution to alleviate the unemployment problem, enable jobless people to receive a basic living protection and through job training scheme, helping people to be reemployed. This tool will form the main foundation of the social security structure, acting as a’safety net’and’shock resistance mechanism’to the society. In 1999, China announces her’Unemployment Benefits Legislation’, stating that unemployment insurance is to become an independent, law regulated and governed system. As economic developments flourish, faults and flaws show, level of legislation setting, standard of protection, limitation in covers and assistance in employment are all found to be inadequate, seriously affecting the implementation of the Unemployment insurance to the society. Britain is being the first country in the world in establishing a compulsory unemployment insurance legal system, enjoying a long successful history with creditable and well organized details. Selecting British unemployment insurance legal system as a study example will assist us in understanding the operation and procedure of this system in the western world. This topic is trying to investigate the development process of this system in England, exploring its advantages and disadvantages, as a result, to see if China can establish her own unemployment insurance legal System in the right direction by learning the English system and eventually, open up China’s unemployment insurance legal System policy and development with comprehensiveness research method, history analysis method, demonstration analysis method and parallel analysis method.This topic is divided into four parts: The first part of the thesis coordinate British unemployment insurance legal system during its early development, mainly analysis the background of its policy development, changes made through different stages and pinpointing its setting, history and basic theory.The second part analysis the characteristics of British unemployment insurance legal system during its early stage. British unemployment insurance legal system adopted the synthetically pattern of unemployment insurance law, The range of Insure all-round, the proportion of pay the fee’s adjustment, ensure horizontal rise, pay conditional strictness. Above points have mirrored a fair and efficient structure in the British social security system, thus enhance its level in social benefits scheme, its economic development and guaranteed equality within the society.The third part is probing into the changes in current British unemployment insurance legal system. Since the 70’s, descending in the British economic developments, over protective level in unemployment causing a financial burden to the government’s treasury, Thatcher’s government in the past has tried and present Brown’s government has been trying to modify the social security policy, adjusting its covered areas, tightening rules in unemployment benefits, down casting social security claims and centralized its governing department. After the changes, unemployment insurance legal system has reached the point where there is a balance between fair and efficiency, compromise between state and individual responsibilities and cooperation between obtain employment and policy adjustment.The fourth part is inspiration to China’s unemployment insurance legal system from the English system. Analysis the past and present of China’s unemployment insurance legal System, and then edit out the mistakes and flaws which exist within the system. Base on all these factors and conclude the contents of the above 3parts, China should mirror the valuable experience of British unemployment insurance legal system in its development process, regulations setting, Broaden coverage range, Rise the paid level, Strengthen administration and superintend mechanism, redefine government duties and continue to strengthen unemployment benefits scheme in reemployment.
