Abstract


Labor security supervision system as the main content of the basic theory of the labor law and labor security supervision department of law enforcement practice is an important way of various countries in the new era of legal regulation and adjustment of labor relations in accordance with the legal authority . In the case of the socialist market economy in China , the increasingly fierce competition between the main players in the market . The main players in the market for their own economic benefit maximization , often at the expense of the interests of workers as a means to improve the market competitiveness of enterprises , which is bound to violation of laws and administrative regulations requirements. View of the workers in a relatively weak position in the labor relations , the national labor security supervision organs must appear as a labor relations managers , supervisors , and the use of public authority granted by the state laws and regulations harm the lawful rights and interests of workers and the employer 's behavior administrative intervention and administrative penalties , in order to safeguard the lawful rights and interests , and promote the harmonious development of labor relations . It also demonstrates the value of labor security supervision system to pursue . However, because of labor security supervision system is not perfect , there are problems in the laws and regulations of labor security supervision , labor security supervision and law enforcement, as well as the surveillance team building , and must therefore be re - sophisticated labor security supervision system in China constantly to keep up with the market economy development rights requirements . This article first chapter mainly describes the basic theory of labor security supervision system , covering the history of the development of labor security supervision system , the contents of meanings , legal characteristics , basic functions and relationship with the labor arbitration . The second part is to write the problems of labor security supervision system , the harm caused and the reasons were analyzed . The third part is the introduction of foreign labor security supervision system , and comparative analysis of labor security supervision system , so as to draw foreign labor security supervision system of the revelation . The fourth part of perfect labor security supervision system in the first three parts on the basis of specific recommendations , including the four parts of the institutional, legislative , oversight , responsibility and perfection of the labor protection , mainly for the problem of labor security supervision system monitoring regime.
