Abstract


Biodiversity after millions of years of natural development, is an important resource for our human survival and development. The value of biodiversity, including not only the value of their own resources, including the scientific value, aesthetic value, indirect value, not only in the past and contemporary human development provides a wealth of resources, its infinite explore the potential is also a guarantee of the future development of the human. However, due to over-exploitation and utilization of human resources of biodiversity, biodiversity is facing a serious crisis, accelerated species extinction, severe loss of genes, causing serious damage to the ecosystem. Important biological biodiversity loss has caused widespread concern in the international context, and to take a series of actions, the establishment of the International Natural and International Alliance of Natural Resources international biodiversity conservation organizations, and formulated the \Convention on biodiversity conservation. Despite these measures of international organizations may not smug, International Convention is not perfect, but these international organizations and international conventions are the international community made a useful attempt to biodiversity conservation and the protection of the world's biodiversity provides a good reference. Biodiversity conservation to become one of the world hot environmental issues by the countries in the world more and more attention. China is one of the richest biodiversity in the world, 12 countries, and its complex natural and geographical conditions contains a wealth of biodiversity resources, and to provide a solid material foundation for China's economic and social development. However, the rapid expansion of our population and rapid economic development brought great pressure to biodiversity, the continuing deterioration of the ecological environment, a serious loss of biodiversity. China has recognized the seriousness of the problem of biodiversity, and the formulation and a series of laws and regulations and relevant policy guidelines, biodiversity conservation, and biodiversity effectively relieve pressure, improve the ecological environment has played a positive role. The law is an important indirect impact on biodiversity driving force and intervention strategies, it is most important to the conservation of biological diversity, one of the most effective means. Our existing biodiversity protection legislation is inadequate, biodiversity protection legal system also needs to be improved, still can not meet the requirements of the protection of biological diversity at this stage. Four chapters of this paper. I first start from the Status of Biodiversity, a brief discussion of the concept and value of biodiversity, and to highlight the important role of the law for the protection of biodiversity; Chapter II summarizes the course of development of the international biodiversity conservation legislation discussed on the basis of the international Convention on the Conservation of Biological Diversity, the Convention on Biological Diversity and the International Trade of Endangered Species of Wild Fauna and Flora Convention highlights. Summarizes the biodiversity protection legislation in the United States, European Union, India, and summarized based on the content of our reference to foreign biodiversity protection legislation; chapter of biodiversity protection legislation in the course of development, and summarize the main principles of law and the legal system to make our current biodiversity protection; Chapter learn from abroad biodiversity legislative experience and analysis of the domestic legal system of biodiversity status quo based on, I pointed out that China's biodiversity conservation Several problems exist in the legal system and to amend the \protection responsibility and accountability, and put forward proposals and measures to improve biodiversity conservation for our legal system.
