Abstract


Xiangjiang River as Hunan’s“mother river”, it provides Hunan’s drinking water, process water, shipping, power generation, pollutant, and so on,it has a very important effction in the province’s development. However, due to the economic development along the Xiangjiang River and the global climate changing, Xiangjiang River happened water seasonal shortage. And in recent years because the development of aquaculture and other industries, Xiangjiang River pollution has new characteristics, pollution control is more difficult. Xiangjiang River water shortage and severe pollution restricts the Xiangjiang River Valley’s social and economic development. To change this situation we should change all of the traditional view of Xiangjiang River, reform the existing water management system , build a Xiangjiang River water rights transactions legal mechanisms.This article divided into six parts research the Xiangjiang River water rights transactions , trying to build a perfect Xiangjiang River water rights transactions legal mechanisms. In this paper, the second chapter was about the theory of water rights trading system, it divided into four sections, including: the”water”’s meaning, the water rights and water rights definition, water rights trading and the definition of water rights transactions and the status of domesitc water rights transactions and problems. the third chapter analyzed the necessity and feasibility of Xiangjiang River water rights transactions legal mechanisms, at first it discussed the Xiangjiang’s serious water scarcity and water pollution made Xiangjiang River water rights transactions legal mechanisms to be necessary, and then discussed the theory of water rights transactions becoming mature, China’s water trade practices, water rights trading system in foreign operations , the implementation of policies and laws made the Xiangjiang River water rights transactions legal mechanisms has feasibility. the forth Chapter divided six aspects described the obstacles and problems in building the Xiangjiang River water rights transactions legal mechanisms , these six aspects is: the lack of profound understanding of Xiangjiang River water resources and water rights trading, the lack of unified river management institutions, the lack of sound policy and law system, the lack of clear basic principles of water rights trading, the lack of specific system design and security , the lack of a sound system of initial allocation of water rights. The fifth chapter was to building a perfect Xiangjiang River water rights trading system, the first was cleared basic principles of Xiangjiang River water rights trade, the second was established a unified regulatory body on Xiangjiang River, the third was improved the initial allocation of water rights system, the fourth was established and improved the Xiangjiang River water rights trading legal system. End of this article referred to the Xiangjiang River water rights transactions legal mechanisms’s defection in nation water rights transactions legal mechanisms’s construction, showed the shortage of the article and the Xiangjiang River water rights transactions legal mechanisms in specific system design still need to further deepen and specific.
