Abstract


Home schooling parents an important part of the educational option in many Western countries, most experienced never legally legitimate course of development. Countries in determining the legality of home schooling, the need to strike a balance between the countries the right to education and the right to parental education, parental education free with the child's best interests. Home education in our country is relatively novel legal issues, its legitimacy has not yet been confirmation of the law, but in order to solve our country there have been a variety of education issues, legitimization and legalization of home schooling has become worthy of our in-depth one of the issues. Parents the right to education and educational opportunities equal as the theoretical basis of the analysis in reference to the United States, Taiwan History and status of implementation of the legal system of education at home under the premise for the draw, trying to home education in our country's legalization efforts , and in the effort to balance the state the right to education and the right of parents to educate parents on the basis of freedom of education and the child's best interests, trying to construct a set of localization suitable for China's national conditions, home schooling legal system to address the reform of the education system in our country practical problems encountered. This paper is divided into five parts, the first from scholars discussion of the events of \awakening requires the liberalization of education, diversified calls, the rise of home schooling can be said to have become an inevitable trend. So, our need to give a legal status of home schooling. After the article in the second part of the analysis of the concept of home schooling, Analysis of the difference between education and family education at home and further information on the legal principles and theoretical foundations of education at home. The parents of the right to education theory and the theory of equality of educational opportunity are two basic theories of education at home, in order to protect the parents' right to education, and equality of opportunity in order to safeguard national education, we must not only give home schooling a legal status, but also to build a sets of a complete legal system to regulate it. The third part of the article discusses home schooling legal system of the United States and China's Taiwan region, in homeschooling historical background based on research, summed up the implementation of the U.S. state of home schooling legal system types and specific mode. In addition, the Taiwan system analysis to that in which our home schooling legal system building looking to learn from. The end of the fourth and fifth in the analysis under the premise of our legal system on the basis of home schooling, details the author for home schooling legal system in China to build the specific ideas put forward their own home education in our country legalized build recommendations. In short, the basic view is that it should be recognized the legal status of home education, and establish a complete legal system of its specification.
