Abstract

Since the reform and opening up, administrative guidance has been gradually used in various fields of administration, and has achieved great practical effect, it makes up for the lack of laws to promote administrative efficiency, to adapt to the rapid development of society, and promote the the development of China's market economy, reducing the friction of the officials and the public, to promote harmonious social progress. With the further development of China's modern market economy and democratic political, administrative guidance will play an increasingly important role in practice. Administrative guidance from the situation in China's current legislation and practice, there are some problems. This paper tries to introduce the basic theory and current status of the administrative guidance, measures to improve its analysis of the current situation and problems of administrative guidance system. The text includes an introduction, body and conclusion of three parts, the basic structure of the article are as follows: Introduction section describes the background and reason, a brief description of the approach to the study of this paper, made a general introduction to the main content of the paper. The first chapter an overview of administrative guidance. In this chapter, the concept of the topics in this article is the analysis and interpretation; analysis of the nature of administrative guidance; an overview of the functions of the administrative guidance. The second chapter of administrative guidance system and the implementation of the main problems. In the chapter on China's administrative guidance normative analysis; analysis of the status quo of China's administrative guidance; described in detail the Administrative Guidance run the problem. The Administrative Guidance Problems include: lack of administrative guidance program regulation; China's administrative guidance exists de facto force; the Administrative Guidance national relief fatigue; Administrative Guidance responsibility is not clear. Chapter measures to improve our system of administrative guidance. In this chapter, the problems in the second chapter of China's system of administrative guidance, in-depth analysis of ways to improve our system of administrative guidance. Mainly include strengthen the Administrative Guidance legislation; improve our administrative guidance procedural law; improve our administrative guidance reconsideration system; improve our administrative guidance state compensation system; improve our administrative guidance administrative litigation system. The concluding part of the judgment made on the development and changes of China's administrative guidance system: With the development of market economy and democratic politics, the degree of legalization of administrative guidance will be increasingly high, but also will play a greater role.
