Abstract


The reason the trial is the phenomenon of the Chinese traditional litigation distinctive litigation trial . Reasonable judgment in Chinese traditional litigation spacious living space for development, judges often appear at the trial in accordance with the law to take care of a reasonable case , when the legal and reasonable conflict , prosecutors and judges are often homes pleading with the law . The full text is divided into four parts, First , in the introduction to today 's academic argument based on the administration of justice in the Qing Dynasty as a starting point to introduce academic Reason Law and the judicial system in the Qing Dynasty , proposed this paper discussed several issues . In the first chapter , the author specifically define \In the second chapter , the reason the trial how the expression and practice of the Qing Dynasty judicial trial is embodied has been devoted . In this chapter, the author attempts to practice and use of reasonable trial in the Qing Dynasty civil and criminal litigation in a case-by-case analysis to explore . In the third chapter , reasonable trial reason to decline in the late Qing Dynasty , discusses the reasonable judgment in the process of modernization of the administration of justice in China , reasonable trial not only in the the Qing Dynasty trial , living space from multiple angles , the administration of justice in today's often can see its shadow , and the formation of the so-called litigation human phenomenon . Finally , through the analysis , I believe that the traditional sense of the trial can still be positive factors of today's reform of the administration of justice , a reasonable trial to explore the role of the administration of justice system reform in China today , a reference to the construction of the rule of law in China .
