Abstract

The selection of leading cadres is intimately associated with appointment for those with both political integrity and professional competence, and more importantly, the cause of the Party and the nation. Constantly, the Communist Party of China (CPC) attaches great importance to the selection of leading cadres, which is always an essential task of the Party. Since the 15th National Congress of the Communist Party of China, the selection of cadres develops towards legalization explicitly, as the implement of the rule of law and the building of a socialist country under the rule of law. A series of Policies and regulations related to the standards and process in selecting leading cadres are issued and consequently the problems of selecting cadres in accordance with the law are resolved to a certain extent. The appearance of the case of Wang Yali in HeBei province, however, reflects many problems in selecting leading cadres. Tracing to the source, it is intimately associated with the affects of legalization in the process of selecting leading cadres. In view of this, as an organizational cadre, based on years of work in practice, the author puts forwards to some opinions and suggestions to improve the legalization of selecting leading cadres.Based on the Marxist stand, viewpoint and method, with reference to Comprehensive use of historical study and horizontal comparison of the different nations, this thesis introduces the inevitable requirements and basic contents in the legalization of selecting cadres. Also, it analyses objectively the obstacle to the legalization of selecting cadres, and then brings up the effective ways, combined with the actual conditions in China.Besides introduction and conclusion, the thesis consists of four parts, about 26000 words.The first part is about the Summary of the legalization of selecting leading cadres, introducing comprehensively the origin, definition, classification and the production and development of the cadre system, analyzing the connotation and significance in selecting leading cadres, and interpreting the realistic value and main contents of the legalization of selecting leading cadres.The second part is about the enlightenment of practice in selecting leading cadres, both home and abroad, to legalization of selecting cadres. In the practicing of selection abroad, the selection of cadres in The Soviet Union and the selection of the leaders in UK and USA are well targeted and judged objectively. Along with the research and review to the Chinese selection system comes to the introduction to the selection of Government officials in Feudal society and historical evolution of selecting cadres since the founding of the Communist Party of China. Thereby, the beneficial enlightenment is achieved, based on the analysis on the practice and system of selection, both home and abroad.The third part is about the problems in the selecting leading cadres. The process in the legalization of selecting cadres exists many real resistances, due to the historical tradition, the existing system and people’s quality and other factors. Under the influence of the feudal bureaucratic culture and the selection model in Soviet Union, the Chinese legalization of selecting cadres lacks of the elements relatively. The process in the legalization of selecting cadres is greatly restricted by the Misunderstanding principle of party canal cadre, deformation of the democratic centralism system, weakened selection procedure and ineffective cadre supervision. In addition, the overall low quality of people and Inscrutable human nature plays a realistic effect on legalization of selecting leading cadres.The fourth part is about the effective ways of Chinese selection of leading cadres. In view of the current dilemma of legalization of selecting cadres, the author brings up many specific measures to promote the process in legalization of selecting leading cadres, from the cultural concepts, the current system, etc. Also it is hoped to establish gradually the thoughts and concepts of legalization according to reforming traditional culture and change the "policy orientation" gradually to implement "legal direction" in the selection of cadres according to coordinating the policy and rule in the selection of cadres. Through establishing a complete system of selecting leading cadres, further standardizing the legal status of the Party in the selection of leading cadres, and improving the Maneuverability of the standard and process in the selecting leading cadres, Fairness and justice in selecting leading cadres will be ensured, based on powerful examination and supervision.
