Abstract


Under the leadership of the Communist Party, the international trade has made tremendous achievements with the devlopement of the reform and opening up of China.China’s foreign trade amounted to＄2.8 trillion in 2010, and ranking third in the world. As the greatest and promising emerging economies, China have its own place in international. The foreign trade export volume under FOB growth year by year in China, and accounted for more than 70% of total exports amount, and still maintained upward trend. Meanwhile, the potential risk under FOB bring huge losses to seller of China. So I do my best to gather relevant data and literature, to conclude that the common risk of the seller under FOB and corresponding response measures and means of prevention. To help our sellers to deal with the risk under FOB in the international trade and protect their rights.This paper is divided into five chapters:ChapterⅠ:Summarizing the trade terms FOB. On the basice of satament of rights and obligations of the buyer and the seller, specifically describes the differences between regulations of several counties and the provision of "Incoterms 2010". Than discusse the common risks suferred by the buyers and propose relative measures. The purpose is describing the risks suferred by seller comprehensively and objectively.ChapterⅡ:Analysis the status quo and the forms of carge connection. In the way of case to analysis the satus quo of cargo connection. So that the seller can aware of the risks under FOB and pay enjoy attention to protect the rights and interests.ChapterⅢ:Analysis the legal facts related to cargo conection. Discuss the partition of the risks and identification of the parties. Those legal issues can help the seller to deal with the distribution of responsebilities and indentify the shipper, the consignee, the carrier and understand their legal statues under the term of FOB.ChapterⅣ:Mainly describe the legislation of China and foreign countries. Based on obove describe. I propose preventive measures to protect the seller from the risks of cargo connection under the term of FOB.
