Abstract

Since China adopted the household land contract responsibility system in rural areas in 1978, the transfer of rural land has always existed, and the countries on the transfer of rural land policy is also supported and permitted. China's rural land circulation refers to the circulation of the circulation and collective construction land use rights of the land contract and management rights transfer of rural residential land use rights. At present, China's policies and laws defined and allows the transfer of rural land contract and management rights. For the latter two, the policies and laws of our country is limited. This paper studies the problem of the circulation of the land contract and management rights and responsibilities of government in the transfer of land contract and management rights focuses on, as well as a brief analysis of the circulation of rural residential land use rights. This article first introduced on rural land, the basic theory of government, and then define the study of rural land circulation and governmental responsibilities; in this theoretically on the basis of analysis of the causes and significance of China's rural land circulation, the relevant legal Policy and Rural Land status quo of China's rural land circulation in government responsibilities Lack, and in-depth analysis of the causes of the problem, and the need for government intervention. Finally, the analysis of Rural Land in government responsibilities. This paper is divided into three parts. The first part is the basic theory. This part is to start from the basic knowledge of the connotation and characteristics, a brief introduction on the transfer of rural land, the connotations and system of government management, analysis of the relevant laws and policies of China's rural land circulation, following good theoretical preparation. The second part of our current situation and existing problems of rural land circulation and cause analysis. Rural Land achieved some success, and a variety circulation mode, such as transfer, subcontract, lease housing sites, also there are many problems, especially in rural land circulation in government duties Absence deviate from the rural areas such as the government's public service; governmental organizations to guide the intermediary market imperfections; rural land transfer market, the lack of support services; rural land transfer policies and regulations are not sound; government on the transfer of rural land management and supervision is not in place. And further raised the need for government intervention, standardized and orderly, the establishment of mature rural land transfer market, government forces supporting system of rural land transfer market needs; effective operation of the land transfer, need the support of the relevant government departments supervision; market there is need for government intervention in birth defects. The third part is the most important, clear focus from the perspective of governmental responsibilities to solve the problem of land transfer and improvement of the responsibilities of government in rural land circulation. Solve the lack of responsibility of government to promote rural land circulation smooth. The major responsibilities of the government in rural land circulation include: development of the guiding ideology and basic principles of rural land circulation; sound management system of rural land contract and management rights; improve rural land circulation market mechanisms; strengthen the rural land contract management rights transfer service supporting system ; according to local conditions, encourage the conditions are ripe area for moderate-scale agricultural operations; safeguard national of farmland security and food security. In this paper, a case study theory and reference practice, combined with China's specific national conditions, and put forward some proposals of Rural Land as well as its process of government duties.
