Abstract

Science and technology are primary productive forces, the world of science and technology in accelerating the pace of building their own, in order to create greater wealth, to retain a place in the international competition. However, more and more attention in science and technology today, although the number of China's intellectual property and rapid growth every year, but the rate of industrialization of intellectual property rights is extremely low. Intellectual property rights to be shelved and can not play its due effect, not only on the intellectual property rights of people adversely, is not conducive to the development of high-tech industry, is not conducive to the promotion of intellectual property strategy. For intellectual property into the difficult problem, conducting in-depth analysis, it was found difficult to translate intellectual One reason for the lack of relevant intellectual property intermediary services market, the second is the traditional way of intellectual property rights into time-consuming, costly, and the intellectual property rights of people not a good financing. We introduce the trust system, the combined system of intellectual property and trust, not only overcome these challenges and efficiently to achieve the transformation of intellectual property rights, for the cause of China's intellectual property also has great significance. Based on the analysis of the barriers to China's intellectual property industry, in response to the problem of intellectual property industry certification necessity of intellectual property trusts and trust system on the definition and origin of the formation of intellectual Trust made a brief introduction. As a core part of this intellectual property trust system, this paper based on China's \The parties include the trustor, trustee, beneficiary rights and obligations, as well as termination of the trust of the subject matter of intellectual property, ownership of intellectual property rights after the termination of the trust. Finally, since no specialized intellectual property of the Trust Law and the relevant laws and regulations, there is no clearly defined intellectual property can be used as trust property, which is not conducive to the exercise of intellectual property trust. In addition, because of the lack of specialized intellectual property trusts, lack of proper registration of intellectual property rights and intellectual property trusts trusts risk prevention mechanism, these imperfections paper proposed some solutions, including not only trust in the intellectual property system itself improvements, but also improve the supporting systems, such as the relevant laws and regulations, the development and improvement of the establishment of risk prevention mechanisms, etc., in order to exert maximum effectiveness of intellectual property trust system, and promote the industrialization process of China's intellectual property. In this paper, to solve our problems of intellectual property industry, to promote intellectual property rights from the academic to the production flow, speed up the industrialization process of China's intellectual property for the purpose of advocating a combination of intellectual property and the trust system, take advantage of this advanced management tools to achieve The rapid transformation of intellectual property rights, accelerate China's scientific and technological innovation and application, and enhance the country's international competitiveness.
