Abstract


Real estate transactions in the real estate market has been communication, service and bridge functions. In recent years, along with China's rapid economic development, especially in real estate development, real estate agents are also increasingly flourish, and in the real estate market is playing an increasingly important role. Real estate agency intermediary activities for the parties to the transaction provides convenient information platform to better promote the achievement of real estate transactions, real estate accelerated velocity, is conducive to real estate resource allocation and utilization. But now China is still in the exploratory stage, with some foreign countries and Taiwan regions, especially compared to the mature U.S. intermediary market, China's real estate market, real estate services, there are still many problems, but these problems are constraining the healthy development of real estate. Therefore, this paper through the real estate agency to analyze the existing problems, explore real estate irregularities manifestations, in-depth study of its underlying causes, and to summarize, summarize and draw many domestic scholars of real estate research and the United States, Taiwan Legislation based on the experience, through comparison and analysis, for violations of the real estate agency put forward corresponding countermeasures. In this paper, the structure is divided into five parts: the first part of the real estate industry to define the concept and briefly describes the characteristics of the real estate agency, function and development, which focuses on the relevant laws and regulations of the generation process. Second part of the real estate irregularities manifestations, such as the intermediary does not fulfill the contract (agreement), publishing false information, false advertising or conceal carry significant value information, do not charge a service fee according to the law, fraud or withheld deposit, \throw \The third part is the real estate irregularities depth analysis of the reasons that the legal system is imperfect real estate, real estate agents access system is not perfect, lack of credit real estate community, government and the industry itself intermediary industry to enhance supervision and poor is real estate irregularities caused an important reason. The fourth part is Taiwan, the United States, the relevant provisions of the Chinese mainland's relevant system reference. U.S. real estate license system, real estate recovery fund system as well as Taiwan's real estate system of civil liability system, operating margin system and so on China have a good reference. The fifth part of the real estate agency for the endless stream of recent irregularities in strict intermediary market access system, a clear and strong intermediary industry association functions, establishing real estate agency industry liability insurance system, improve real estate services such as dispute settlement mechanisms corresponding countermeasures.
