Abstract


Margin trading the overseas developed securities market is a mature trading system originated in the United States , is a form of securities credit transactions , including financing and securities lending . Margin trading mechanism has to improve market liquidity buffer market volatility , and found that the positive effects of the market at reasonable prices , Hedging and institutions to create earnings , improve the securities market mechanisms to promote the innovation of financial products , optimize resource allocation of financial markets important ways and means ; such transactions can also lead to a negative impact speculative . China had expressly prohibited by laws and regulations , the implementation of margin trading business . The new Securities Act was promulgated in 2006 , followed by the relevant laws and regulations , approaches have been put forward . Margin trading business in China has been officially launched in March 2010 . However , China's securities market is still in the acceleration during the transition period , some deep-seated institutional problems still hamper the further rapid development of the securities market . In view of the margin trading in China has just started , legislative and judicial practice are faced with many problems . This paper analyzes the full implementation of the system design issues margin trading business there are still legal conflict and blank at this stage in our country , and Trust Law , for example , guarantee convergence , conflicts of interest and other issues . Improve and perfect the system system design , to solve these problems in order to ensure the healthy development of the margin trading .
