Abstract


Low-carbon economy was raised by the United Kingdom when the frame system of international climate suffered great frustration. Low-carbon economy is a model of economy development which is based by low energy-consumption, low pollution and low emission. Low-carbon economy pursues green GDP. Radically, the development of Low-carbon economy is not changing the point of growth but using a way of healthy development to replace the traditional way of development.During the past thirty years of development, the way of High-carbon development is facing to choose a new development point, which is a hard work for our country. As the biggest developing country of the world, China must take its responsibility to maintain its figure.It is no doubt that China will not be a lone wander when the world is walking into“low-carbon”. Low-carbon economy is an inevitable choice for China. The emission of carbon is from the activity of human beings, it is a problem of development. The development of Low-carbon economy means the living way of human must change, which is forced or spontaneously. At the beginning of Low-carbon economy, the forcing power is very important, which is usually comes from law. So in the process of developing Low-carbon economy, we must construct our legal system.Low-carbon economy concerns the ecological system and the produce and live of human beings, it also connects with the national interests, so the settle of the problem of Low-carbon economy needs all the countries in the world. Using law to cope with Low-carbon economy is an important measure. This paper will analyze the present situation of Low-carbon economy development of our country and draw on the successful legal experience of the developing countries. The author tries to find the deficiency of our environmental legal system and raise the assumption of complete our law of Low-carbon economy.
