Abstract

\Foreign intellectual property law the applicable law is the important part , related to foreign-related civil subject , many aspects of the foreign inheritance , foreign debt and foreign-related civil relations , particularly close relationship with the general part of the law , making it the \law \Foreign-related intellectual property rights law applicable to advanced theoretical results draw on a wide range of contemporary private international law , legislators and scholars of China 's private international law , drawing on the current world advanced legislative experience , and full summary of the legislative and judicial basis of practical experience in the past three decades , China formulated introduced have some advanced and inclusive , and that China has bid farewell to the conservative and backward state into the advanced ranks of the world 's foreign-related intellectual property law applicable legislation . Substantive work needs taking into account China 's foreign-related intellectual property law applies , with reference to the relevant provisions of the Private International Law in the developed countries , China's foreign-related intellectual property law applicable law is yet to the reality required contents have not won come , these have yet to be be improved in future legislative and judicial interpretation . For this article , the author uses the method of historical research , comparative research , law hermeneutic , from combing this Act introduced legal environment , foreign-related intellectual property rights and its international and domestic protection to start , and then analyzed the new introduction of foreign knowledge legislative Value Orientation property laws applicable law , comparing the practices of other countries around the new law ordinance , one by one to analyze the characteristics of the legislation , pointed foot and inadequacies , concludes with the author's views or ideas to the law applicable to the period of China 's foreign-related intellectual property further improve the force to contribute their share of the international private law students .
