Abstract


With the rapid development of science and technology, the quantity of e-wastes has increased unprecedentedly. Considering the factors such as economic interest, environment protection and so on, developed countries do not want to treat e-wastes at home and have an intention of exporting them to other countries,and some developing countries usually accept those e-wastes for short-term economic benefits. Problems with the transboundary movements of e-wastes are beginning to emerge and becoming a big challenge to global environment and the sustainable development of human society. How to improve the regulation of the transboundary movements of e-wastes is a focus of attention of the international community and also a practical problem which needs to be solved desperately. This dissertation first summarizes the legislation status concerning the transboundary movements of e-wastes around the world, on the basis of which it finds out several problems in the current legal system and tries to give some solutions. The dissertation is divided into five sections:Section one is an introduction to the background of the transboundary movements of e-wastes. This part defines some basic concepts such as waste, e-waste and transboundary movement, and analyses the origins of the transboundary movements of e-wastes and the necessity of regulating.Section two provides an introduction to the legal framework on the transboundary movements of e-wastes on the level of the world. This section is divided into three subsections, which are the regulation by global treaties, the regulation by regional treaties, and the regulation by some typical domestic laws, trying to describe the current status of regulations on the transboundary movements of e-wastes from different angles.Section three focuses on the current legal system and the problems existing in the framework of the regulation. There has been several legal systems regulating the transboundary movements of e-wastes, such as environmentally sound management, prior informed consent, and illegal traffic control. However the regulation on this issue still has some limitations. This part lays a sound foundation for the following suggestions on the improvement.Section four puts forward some suggestions to improve the regulation on the transboundary movements of e-wastes. In view of the existing problems, this paper suggests that the Basel Convention be given full play to its function. The regional cooperation should also be strengthened and the WTO rules adjusted to the regulations of the transboundary movements of e-wastes. What’s more, it is necessary for every country to modify its domestic provisions.Section five gives some suggestions on the regulation of the transboundary movements of e-wastes in China. This part analyses the existing problems from the current status of legislation and the enforcement of e-waste laws, and tries to offer some sound advice on the improvement.
