Abstract

Community Corrections , also known as community treatment , community treatment, a correction of a relatively non- prison sentence of imprisonment of implementation . It does this by criminals to keep in touch with the community and using community resources to transform the treatment of offenders , management education is all offenders in the community environment in general. With the execution of punishment by the harsh way toward easing , with the purpose of execution of punishment shift from punishment to treatment and community corrections such humane, open- offender correctional system more acceptable to States . Entering the new century , China's theoretical and practical sides began to carry a lot of community corrections exploration , the country is now a full trial of the system . Except the last part of this article , is divided into five chapters , the use of empirical analysis, comparative analysis, feasibility studies and other qualitative and quantitative methods to analyze research and practice of community correction system in Shandong province and abroad , and made recommendations accordingly. This paper is divided into five main parts. The first part introduces the concept and scope of community correction system . Firstly, the concept of community corrections is limited to a narrow concept of community corrections , that only crimes against people, it is the prison execution corresponding penalty enforcement system. The qualifying offenders placed in the community , under the special state organs, social groups and civil society organizations as well as volunteers to assist in the judgment, order or decision within a period of time determined , correcting its vices criminal psychology and behavior , and to promote its smooth return of non- custodial sentences to perform social activities . In China , the scope of community corrections is: be sentenced to control , is probation , was temporary probation , parole was convicted and deprived of political rights and to serve their sentences in the community five criminals. It also clearly states: In the case meets the statutory requirements for minor offenses , subjective vicious little juvenile offenders , old sick prisoners, as well as lesser crimes first offense, guilty of negligence , etc., should be used as the focus for non- custodial measures implementation of Community Correction . Based on this scope is considering subjective vicious criminals , crime severity , the danger to society and social acceptance of offenders , community management feasibility correction made on such factors as the provisions of temper justice properly comprehensive moderate, in line with China's national conditions and social psychology , with a strong operability. The second part focuses on the community corrections pilot in Shandong Province and comprehensive trial situation . First introduced in Shandong Province to carry out the experimental work of community corrections : First, institutional development aspects . Second, the institutional set up . Third, funding for security. Fourth, with respect department . Fifth assessment community corrections staff. Sixth, the management system. Secondly introduced since February 26, 2010 , Shandong Provincial Higher People's Court of Shandong Provincial People's Procuratorate , the Public Security Bureau in Shandong Province , Shandong Province, Department of Justice jointly issued the \Yantai City agencies and community corrections settings in the pilot work , staffing , correct objects and so on. The third part introduces some advanced domestic provinces and Community Corrections work experience and practice , community corrections and Shandong Province with for comparison. Firstly, the advanced experience and practices in Beijing, Shanghai , Zhejiang, Jiangsu four provinces . Secondly , the community correction in Shandong Province and other provinces and cities to compare , analyze their similarities and Department of Shandong Province deficiencies that exist . The fourth part of the article describes the development and representation of practices the U.S., Canada , Japan and other countries of community correction system , and with the Chinese community correction system were compared. Through comparative analysis, found that the lack of community correction system and practice of China exists , mainly: Social Thought awareness , legislation and social forces participation aspects . The fifth part of the article made recommendations for the future development of the community correction system , including: legislation can be implemented on a regional First legislation ; Second, community corrections improve the specification and the actual implementation ; Third, the implementation of community corrections agencies and specific operations on improving ; fourth is actively expanding investment and participation in society . Finally, I believe that through the joint efforts of community correction system of the country and society as a whole will be able to continue to develop in our country to improve and play an important role should be.
