Abstract


People's mediation system as one of China's grassroots self-government system , with civil society , autonomy . People's mediation system not only inherit and carry forward our traditional civil mediation , but also with the new characteristics of the times . Compared with the lawsuit , the people's mediation is a low cost , convenient mode of dispute resolution , it is through consensual parties to the dispute , the parties to educate , persuade , and ultimately eliminate barriers , solve disputes goals. As President Lincoln said : \since its inception , by the government and the people 's trust and welcome in resolving civil disputes, maintaining social stability played an important role , it is also respected by the international community , known as the \However, with the economic and social development , people's mediation system once the decline , and its role has been challenged . Resulting in the decline of people's mediation there are many reasons : not only external changes in social structure , enhance the people's awareness of litigation , the impact of the market economy , but also the people's mediation own case range is too small , the organization set up is not perfect, the low quality of people's mediators , people's mediation agreement and other aspects of lack of effectiveness factors .
