Abstract


As a new type of criminal reconciliation criminal dispute resolution , aimed at the pursuit of perpetrators and victims repair existing social relations , help to resolve social conflicts , but also conducive to harmonious society , is the judicial practice a useful attempt , but also for the reform of China's criminal justice system provides a new way of thinking. Since the existence of Tibetan customary law , criminal settlement system in the Tibetan areas of application has a rich experience and traditional resources , it can be for Tibetan Customary Law and National Criminal statutes to provide a platform for dialogue between for the state criminal statutes and Tibetan integration of customary law to establish an effective way to gradually reduce the conflict between the two or even disappear . This article is six chapters , the first chapter is an introduction ; second chapter of the criminal settlement system based on Chinese and Western rheological study, designed to explore the Chinese criminal reconciliation anyway , and Tibetan criminal settlement applies to analyze the situation , as criminal settlement system in the Tibetan areas and the need to build the application , feasibility , providing a realistic basis ; Chapter anchored in Tibetan customary law , criminal settlement system for the Tibetan foundation of the theory for the criminal settlement system in Tibet the theory applies to clear away obstacles ; fourth chapter from the criminal settlement system on the Tibetan social harmony and stability, satisfaction Tibetan dispute resolution , litigation efficiency and conservation of judicial resources and personal costs of four aspects , pointing out criminal settlement system the feature in the Tibetan areas applicable ; fifth chapter of Gannan Tibetan Autonomous Prefecture to inspect a sample of four typical cases of true originality analysis reflects the most intuitive criminal settlement system in Gannan Tibetan reasonableness applicable , feasibility , necessity , advantages , features and problems , the most compelling evidence of the criminal settlement system in Tibetan areas of functionality where applicable , also for the criminal settlement system constructed in Tibetan areas to provide a strong basis and practical learning ; Chapter VI on Tibetan actual criminal settlement system has been designed and constructed model and targeted criminal settlement system for the construction of Tibetan proposed legislative suggestions .
