Abstract


Since the 1890 U.S. jurist for the first time put forward the concept of privacy , privacy has been widespread concern , and gradually get the recognition and protection of the world . With the changes in the economic and social development and social attitudes , the connotation and extension of the traditional privacy extended to the financial sector , the concept of financial privacy . Banking customers and financial Privacy is generated on the basis of the traditional privacy and evolved a new type of privacy, it has become an important part of modern banks to establish credit image conduct business competition . It breaks through the traditional privacy does not have a property , the Financial Privacy in commercialization explosion can easily violated . And the corresponding financial privacy there is still no clear, unified concept and financial privacy protection norms , such extremely conducive to safeguarding the legitimate rights and interests of the majority of bank customers , is not conducive to encourage financial transactions . Therefore learn from foreign legislative and experience to gradually establish legal protection of financial privacy of bank customers imminent , according to China's actual . In this paper, on the basis of introduce the the Financial Privacy basic problem , seriously discussed the need for its existence and its legal basis , aims to draw on the legal system of the overseas banking customers and financial privacy , and combined with our specific analysis and synthesis proposed some ideas to build the system of our bank customers financial privacy laws .
