Abstract


To restructure the system is the most complete U.S. Bankruptcy Code entry point , trace the evolution of the U.S. Bankruptcy Reorganization , the pursuit of the law administered by the debtor mode value , the pattern positioning study of the structure of rights and obligations described under the Bankruptcy Reorganization administered by the debtor's right to the boundary set . This article will use the transaction cost theory of law and economics , information economics theory to explore the laws administered by the debtor the right to limit the rationality and effectiveness . Reorganization system in China has initially established , the system is not perfect , administered debtor positioning , the rights and obligations of the structure , the behavior of rationality that standard there are still missing . Administered by the debtor the right to limit , the academia has been carried out some research , but it has not been systematically analyze , in particular the lack of standards for the maintenance of conduct of the debtor reasonable discourse . This paper attempts to the jurisprudence of the United States as a blueprint to explore the identified standards , which provide a reference for our re-engineering system improvement .
