Abstract


Advance notice in relation to civil registration system is an important system property changes, it is to risk prevention for the purpose of looking forward to real property to protect the rights of people based on their real property claim made in the interests of creditors. It originated in the early Prussian law, in Germany, Switzerland, Japan and other civil law countries, and Taiwan region of China are clearly defined, the system real estate property is an indispensable component.In recent years, with the booming economy and society, real estate transactions in the proportion of our economic life is increasing. In order to meet the needs of social and economic development, March 16,2007 of the Tenth National People’s Congress adopted the fifth meeting of the "Property Law", in the absorption of foreign advanced on the basis of legislation of the actual situation in our country, for the first time to establish a special law in the form of advance notice registration system.This article starts from the registration system that the concept and its characteristics, elaborating the history of the real estate registration system, and make a comparative study,combining such theories of the scope, effect, occurrence and the eradication of the real estate registration system abroad, on the basis of the analysis to the registered owner of the notice relates to the protection of the regulations,give a comment on the jus, and the measures of real estate registration system of our country.
