Abstract


With the continuous expansion of the executive power , the possibility of abuse of administrative power is growing , and how to regulate administrative power has gradually become the world issues of common concern . The controlling function effectively grasp depends on the status quo of administrative procedures and related issues , it helps the checks and balances between the administrative relative person with administrative body , in order to fully protect the legitimate rights and interests of the administrative counterpart reasonable regulation and executive powers . The main purpose of the administrative due process system construction is to prevent the abuse of administrative power . In recent years, the Chief reflected in the relative contradiction with the executive . Administrative organs willful breach of statutory procedures for violations of administrative cases relative to the legitimate rights and interests . The emergence of many problems , mainly due to the Procedural Regulation on public rights to be further improved , the the administrative counterpart participation in administrative decision-making rights are not given adequate attention . Heavy physical light program is still the situation today under Executive main administrative act , the the program system does not give full play to its proper performance . Administrative procedures for to standardize administrative powers to protect the legitimate rights and interests of citizens play an important role . Further, the construction of the system of administrative procedures , the main purpose Procedural Regulation of public rights , procedural safeguards administrative act legitimate timely and effective , give full play to the the procedures system controlling function , in order to achieve the effective protection of the legitimate rights and interests of the parties . Based on this, this paper attempts to corresponding explore the administrative procedures of the controlling function , first define the functional definition of the administrative procedures controlling played necessity argument , then the function of the administrative procedures , thereby effectively administrative procedures controlling targeted constructive comments .
