Abstract


Copyright Pledge as an emerging security interest in , the debtor or a third party the copyright property as a security for debt , when the debtor defaults , the creditor is entitled by law to the specific rights or auctioned , the proceeds of the sale of priority mortgages. With the development and prosperity of the capital markets in intellectual property , copyright pledge of such rights by way of security increasingly favor of international investors . However, due to the late start in China 's intellectual property system , the specification of the relevant laws and the legal effect of the copyright pledge is still rough. Therefore , the study of the legal effect of the Copyright Pledge has important theoretical and practical significance . The copyright pledge legal effect is mainly related to four aspects : one set of copyright pledge , which is the basis of copyright pledge to produce legal effects . Specifically, the Copyright Pledge settings include three aspects , namely the legal characteristics of the Copyright Pledge Requirement of Effectiveness of the copyright pledge and to explore the Copyright Pledge special type .
