Abstract


Kindness with by this way of travel not only provides a convenient for people, and increase the goodwill on both sides of the friendship, and are beneficial to the society. However, the current law is not well in the tort liability, cause nobody is unknown, the trial without a clear legal basis. In this paper, the kindness in the tort liability imputation determination, and put forward some views and Suggestions. This paper text consists of three parts: the first part mainly summarizes the kindness to take the concept, characteristics and nature of; The second part mainly expounds the kindness to take the cognizance of tort liability, and kindness on tort liability theory and the judicial present situation; The third part mainly through the comparison, proposed to establish goodwill in the tort liability system and perfect the compulsory motor vehicle traffic accident liability insurance system suggestion.
