Abstract


The examination prosecution system is the entire criminal prosecution system’s important component and the important lawsuit link, must fulfill the detection surveillance function forward, must make backward whether to sue decision; On the one hand must guarantee entire criminal prosecution’s smooth advance, on the other hand must guarantee that the lawsuit litigant legitimate rights and interests do not receive from the lawsuit activity "not, when violates"; But on the examination prosecution system is not the place which the acme of perfection existence also needs to consummate. This article through the outline introduced that our country examines examination prosecution system basic contents and so on prosecution concept, characteristic, deadline, object, basic task, flow, then reflected by the case form the examination prosecution working practice existence question, these questions are mainly:Must takes into custody the measure to abuse, the laissez faire detection institution to abuse the detection method, the exhibit reassignment with the examination not strictly, the evidence examination to be not very careful. Finally exists the question studies our country’s examination prosecution control system’s perfect method for the turning point.
