Abstract


Sentencing is an important element in the sentence , many of our scholars who have been exploring seeking a comprehensive sentencing system . \This paper attempts to exploit the knowledge of cybernetics system of sentencing system, combined with sentencing rules \This paper is divided into three parts: the first part through the collection of data , summarize the current administration of justice in sentencing a common problem . From the \The second part details the sentencing methods . This section covers the foreign sentencing sentencing methods and methods of comparison . Focused on the benchmark on the sentencing issue. Sentencing benchmark seems to be a consensus can not be reached the issue , mainly because of the sentence based elements can not be determined on the basis of some scholars punishment, the starting point and the starting point to see as a concept , resulting in the phenomenon of chaos . Through the benchmark sentence , sentencing benchmarks and the starting point of distinction. Determine the sentence based concept , help solve problems for sentencing . Sentencing Sentencing is important , \Repeat evaluation not only cause imbalance sentencing , but also so that the masses of the entire judicial professional quality workforce doubt . So to distinguish between the good sentencing , crime and crime constitute a plot. Second, the classification should clarify sentencing , legal and judicial interpretation of the provisions on sentencing .
