Abstract


Protection of civil rights under the state of emergency is mainly reflected in three aspects of the legislation to protect and administrative safeguards and judicial protection in the state of emergency under the protection of citizens 'right to know is particularly important for the protection of citizens ' right to know , as well as other rights , which is conducive to the citizens timely understanding of the state of emergency in the event the degree of risk , and the government handle it properly ; help to improve administrative efficiency ; conducive to citizen participation in the battle to eliminate the state of emergency . I mainly study the emergency legislation to protect the citizen 's right to know , first described the state of emergency as well as the right to know the situation , proposed under a state of emergency on the significance of the citizens ' right to know to protect through legislation should comply with some basic principles, as well as our existing laws , summed up the legal protection of citizens the right to know the state of emergency , there are some shortcomings : 1 . various legal norms different understanding of the state of emergency ; 2 . fundamental rights has no clear right to know the legal status , there is no development of minimum human rights standards ; 3 . imperfect information disclosure system ; 4 . lack of procedural requirements for relief ; emergency system is imperfect , and some incidents did not pass be determined by law , or unexpected system established , some from a departmental rules or normative documents identified normative .
