Abstract


According to world health organization (WHO) statistics, China in recent years, every year the number of deaths from drugs damage of about 19, 20000 people, that does not include health damage caused by the adr, the number of dysfunction. In this context, the adr tort and civil remedies has gradually become an important realistic problem of common concern to society. With the challenge of the adr tort and provide medication for weak broad consumer safety guarantee, to be the important subject of the legal science common concerns. The adr tort is a special kind of tort liability. Although "tort liability act" introduced to the adr of infringement civil liability shall be investigated for provided the certain basis, but for the adr tort liability provisions are too general and need further discussion. This article proposed for infringement of the adr specialized legislation, and for the adr basic imputation principle in tort, the cognizance of causality and the distribution of the burden of proof has carried on the preliminary discussion; The non-lawsuit about infringement of the adr relief system in China has just started, suggest to take corresponding measures to be perfected step by step.
