Abstract

Our country law for private higher schools more nature and legal status of the problem from the perspective of civil law study, rarely from the perspective of administrative law. And frequently appeared in the judicial practice of disputes between private higher schools and students, launch and promote the academic research on this issue. In private higher school students exercise, education administrative power belongs to the organization authorized by the laws and regulations, with administrative subject qualification. The formation of this view has theoretical foundation, practical foundation and legal basis. Clear private higher schools from the perspective of administrative law is administrative subject qualification, the value theory is to perfect our country's theory of administrative subject, administrative act theory and the theory of administrative remedy; Its practical value lies in the establishment of the private higher school student's administrative relative position, the status of administrative reconsideration of the respondent and the administrative proceedings the defendant's position.
